Far-Right Republican Accused of Stiffing Student Debate Champion 2026

A far-right Republican candidate in Florida’s governor’s race has been accused of stiffing a high school debate champion over $8,000 in scholarship money. The lawsuit, filed by student Briana Whatley, alleges that James Fishback, founder of Incubate Debate, failed to deliver the full promised award after she won the national championship.

Background of the Incubate Debate Scholarship Dispute

Briana Whatley, now a second-year history student at Florida State University, won the 2024 Incubate Debate national championship, earning a $10,000 check plus two $500 area awards. A letter from the company promised the full amount would be paid upon her high school graduation in May 2024. However, according to Florida Politics, Whatley is suing for the remaining $8,000 that was never delivered.

The lawsuit, filed in small claims court in Broward County, names Incubate Foundation Inc and Fishback personally. It alleges that after the initial win, the company ignored emails, then tried to alter payment terms, and delayed payments for months. Fishback reportedly admitted in a November 2025 text that he “totally dropped the ball on this one,” but only paid $3,000 in December, leaving the balance unpaid.

Key Allegations Against James Fishback

The filing claims Fishback “personally evaded and defrauded” Whatley by ignoring communications, blaming a terminated employee for the written terms, and falsely claiming an unwritten “installment policy.” This behavior raises serious questions about the candidate’s integrity and financial reliability, especially as he runs for governor.

Fishback, 31, is challenging front-running US congressman Byron Donalds and Jay Collins for the Republican nomination. The primary is set for August 18, and this lawsuit could impact his campaign’s credibility.

Comparison of Promised vs. Actual Payments

Impact on Students and Debate Community

Incubate Debate was created to encourage young people to engage in political discourse. Failing to honor scholarship commitments undermines that mission and discourages students from participating. Whatley’s case highlights the risks students face when relying on promised educational funding.

• Scholarship winners may face financial hardship when payments are delayed.
• Trust in debate organizations is eroded by such disputes.
• Legal action becomes necessary when communication fails.
• Candidates for public office should be held accountable for business practices.

Legal Proceedings and Next Steps

Whatley’s lawsuit seeks the remaining $8,000 plus court costs. The case is in small claims court, which typically handles disputes under $8,000 in Florida, but the total claim may exceed that, leading to potential jurisdictional issues. Fishback has not publicly responded to the lawsuit as of this writing.

This controversy comes at a critical time for Fishback’s campaign, as voters weigh character and financial responsibility. The outcome could affect his standing in the August primary.

FAQ

This case serves as a cautionary tale for both students and political candidates. For students, it underscores the importance of verifying scholarship promises. For voters, it raises questions about the character of those seeking public office.
