Jay Clayton, President Trump's nominee to become the next director of national intelligence, refused to say that Joe Biden won the 2020 election during his confirmation hearing on Wednesday. Clayton instead stated that Biden was "certified" as president, sparking sharp pushback from Senate Democrats.
Clayton's Evasive Answers on 2020 Election Results
Under questioning from Senator Mark Kelly of Arizona, Clayton acknowledged that Biden "had the most electoral votes, followed our process, and was declared the winner." However, he stopped short of explicitly saying Biden won the election, a distinction that frustrated Democrats on the committee. Kelly responded, "If you can’t disagree with him when he’s not in the room, will you be able to disagree with him when he is?"

Clayton also dodged questions about previous election integrity claims and whether a White House official asked him to subpoena a group of New York Times journalists as part of an alleged national security investigation. His refusal to directly address the 2020 election outcome raises concerns about his independence and willingness to challenge false narratives.
Background on Jay Clayton and the Intelligence Role
Clayton, if confirmed, would replace Bill Pulte, whom Trump installed as acting director of national intelligence last month. Pulte’s tenure has been deeply divisive on Capitol Hill, with members of both parties arguing his background as chair of a federal mortgage regulation agency is insufficient for overseeing America’s intelligence agencies. Critics also cite Pulte’s unwavering loyalty to Trump and willingness to punish political enemies as dangerous traits for a spy chief.
Trump is scheduled to address the country Thursday night about supposed fraud in the 2020 election. Pulte has reportedly pushed Trump to make the address and potentially unveil purported evidence of election interference. Trump may also disclose newly declassified intelligence reports claiming a foreign nation interfered in the 2020 race.
