The Jens Spahn scandal involving his surrogate baby has rocked German politics, exposing deep divisions over family, morality, and party loyalty. Up until last week, Spahn was a model of political success, but his resignation after announcing fatherhood through a surrogate mother in the US reveals how reproductive politics remain a red line in conservative Germany.
Why Surrogacy Brought Down a Political Powerhouse
Jens Spahn, a longtime member of the Christian Democrats (CDU), served in top government roles including health minister during Covid. Yet the revelation of his son’s birth via surrogacy triggered outrage within his own party. While surrogacy is illegal in Germany, the CDU had previously tolerated a similar case involving fellow member Hendrik Streeck. So why did Spahn fall?

The answer lies in hypocrisy and political baggage. Spahn was a divisive figure with ties to the US right, feared and disliked by many. His resignation underscores that even the most powerful politicians can be brought down when they cross unwritten moral lines.
Germany’s Surrogacy Landscape
Surrogacy in Germany is banned under the Embryo Protection Act. Only the Green Party supports legalizing unpaid, “altruistic” surrogacy. The CDU remains firmly opposed. A recent poll shows Germans are evenly split, with 20% having no opinion.
| Party | Stance on Surrogacy |
|---|---|
| CDU | Opposed – illegal practice |
| Green Party | Supports legalizing unpaid surrogacy |
| German Public | Evenly split (40% in favor, 40% against, 20% no opinion) |
