The Idaho abortion ban, one of the strictest in the United States, could be overturned in November’s election as voters prepare to decide on a ballot measure that would restore reproductive rights. The Idaho secretary of state certified the measure on Monday, following a petition drive by Idahoans United for Women & Families that gathered over 100,000 signatures. This initiative aims to replace the current near-total ban with a law allowing abortion until fetal viability, typically around 21 weeks, and protecting access to contraception and fertility treatments.
What the Ballot Measure Proposes
The proposed measure would create a state law for “reproductive freedom,” rather than amending the constitution. It mirrors protections that existed before the U.S. Supreme Court overturned Roe v. Wade in 2022. If passed, Idaho’s law would permit abortion up to fetal viability and allow individuals to make their own choices regarding abortion, contraception, and fertility care. This would significantly roll back the current ban, which prohibits abortion at all stages of pregnancy with limited exceptions.

Current Abortion Ban in Idaho
Idaho is one of six states where the abortion ban lacks exceptions for the health of the pregnant person. It only allows abortion to save the woman’s life or in cases of rape or incest. In 2023, Idaho became the first state to criminalize helping a minor obtain an abortion without parental consent. These strict penalties have driven many healthcare providers out of the state, according to reports from The 19th.
| Key Differences | Current Idaho Ban | Proposed Measure |
|---|---|---|
| Abortion Timing | Banned at all stages | Allowed until fetal viability (~21 weeks) |
| Exceptions | Life of mother, rape, incest | Includes health of the woman |
| Contraception Access | Restricted | Protected |
| Fertility Treatments | Unclear | Explicitly allowed |
National Context and Voter Trends
Since the fall of Roe v. Wade, abortion rights advocates have faced mixed results at the ballot box. Nationwide, they have lost four statewide votes but prevailed in 14 referendums. Idaho’s measure joins a growing number of state-level efforts to restore protections. The outcome in November could signal shifting public opinion on reproductive rights.
