Early Release Prisoners Reduced by 1,000 After Burnham Rule 2026

The early release prisoners scheme in England and Wales has been scaled back by about 1,000 after Andy Burnham’s intervention to exclude those convicted of rape, serious child sexual offences and grooming. This significant policy shift aims to balance prison overcrowding with public safety, affecting thousands of inmates and reshaping the justice landscape.

What Changed in the Early Release Scheme?

Justice secretary Alex Norris announced that 5,000 prisoners would be released over 10 months starting in October, down from the original plan of 6,000 from September. The prime minister confirmed on Monday that prisoners convicted of rape, serious child sexual offences, and grooming would no longer be eligible for early release, following intense pressure from MPs, victims, campaigners, and frontline prison officers.

Norris told Sky News that he would have liked to go further in blocking early release for some prisoners, but doing so would have caused the prison system to “break down.” He emphasized that the government would not need further emergency release schemes, as sentencing changes would provide “long-term security” for prison capacity.

Why Did Burnham Intervene?

Andy Burnham, the Mayor of Greater Manchester, has been a vocal critic of the early release program, particularly its impact on victims and public trust. His intervention led to the exclusion of serious offenders, a move that has been welcomed by victim advocacy groups but also sparked debate about prison capacity.

Impact on Prisoners and Families

Norris acknowledged that the proposals had “created harm” for grieving families, such as the wife of PC Andrew Harper, Lissie, and expressed his anger at being in a situation requiring significant changes that have real impacts on people’s lives. Harper’s mother, Debbie Adlam, said her family was “paying the price” after learning her son’s killers remained eligible for early release under the government’s plans.

Some prisoners serving time for certain sexual or violent offences will still be eligible for release at the halfway point of their sentence if they have not committed serious breaches of prison rules. This applies to individuals like Jessie Cole and Albert Bower, whose cases have drawn public scrutiny.

Comparison of Original vs. Revised Early Release Plan

Key Takeaways for Justice Policy

• The early release prisoner count has been reduced by 1,000 due to Burnham’s intervention.
• Serious offenders are now excluded from the scheme, addressing public safety concerns.
• Prison overcrowding remains a critical issue, with officials warning of system breakdown.
• Victims’ families continue to express anger over the eligibility of some offenders.
• Sentencing changes aim to provide long-term capacity solutions without emergency releases.

Future of Prison Capacity and Sentencing

Norris stated that the government is “out of the doom loop” of emergency releases, which previously let individuals out without proper controls. He stressed that sentencing changes would provide a sustainable approach to prison capacity, though he admitted the current situation is far from ideal.

The revised scheme reflects a delicate balance between addressing overcrowding and maintaining public confidence in the justice system. As the October release date approaches, prison authorities will need to manage the logistics of releasing 5,000 prisoners while ensuring public safety.
