Donald Trump has said Benjamin Netanyahu, the Israeli prime minister, “will not be arrested” if he visits the US, escalating a political standoff over an International Criminal Court arrest warrant. The statement came after New York City Mayor Zohran Mamdani suggested he might detain Netanyahu during the UN General Assembly in September.
Trump's Truth Social Post on Netanyahu Arrest
In a Truth Social post on Monday, Trump declared that Netanyahu “will not be arrested, in any way, shape, or form while in the United States of America.” He framed the Israeli leader as “fighting against the Islamic Republic of Iran” and argued that “the only ones that should be arrested are the people that led Iran into this unprecedented spiral of death and destruction.”

Mayor Mamdani's Push for Arrest
Speaking to the New York Times, Mamdani said, “I believe that prime minister Netanyahu belongs in The Hague,” referring to the ICC headquarters. He called Netanyahu “a war criminal who has been charged by the international criminal court” and noted that many share this view “because of what his actions have wrought over these past many years.” Mamdani, who has described Israel’s war on Gaza as a genocide, is in “an active conversation” with New York City’s law department about his legal authority to direct police to detain Netanyahu.
ICC Warrant and US Jurisdiction
The ICC issued an arrest warrant for Netanyahu in November 2024 over alleged war crimes in Gaza. However, the US does not recognize the ICC’s jurisdiction and is not a party to the court. This legal gray area creates a clash between international law and US sovereignty. Mamdani pledged during his mayoral campaign last September that he would arrest Netanyahu if he traveled to New York, stating, “It is my desire to ensure that this be a city that stands up for international law.”
