Coles has taken the Australian Competition and Consumer Commission (ACCC) to federal court in a bid to open a second supermarket and liquor store in Kalgoorlie, escalating a legal battle over market competition. The supermarket giant is appealing the ACCC’s decision to block the expansion, arguing it would benefit consumers in the West Australian mining hub. The first case management hearing is set for tomorrow in Melbourne, with a separate directions hearing on Coles’ appeal to the Australian Competition Tribunal.
Why the ACCC Blocked Coles’ Second Kalgoorlie Store
The ACCC determined that allowing another Coles in Kalgoorlie would likely push out a smaller rival, reduce consumer choice, and leave shoppers worse off. Currently, Kalgoorlie has six supermarkets—two IGAs, a FoodWorks, Woolworths, Coles, and Spudshed—and previously had seven, including two Coles stores for much of the past decade. The regulator’s concern centers on market concentration and its impact on local businesses.

Key Arguments in the Court Case
Coles argues the ACCC’s decision is overly restrictive and fails to account for the growing population in Kalgoorlie. The company contends that a second store would increase competition, lower prices, and improve access for residents. Legal experts note that this case could set a precedent for how antitrust laws apply to supermarket expansions in regional Australia.
| Factor | ACCC Position | Coles Position |
|---|---|---|
| Impact on smaller rivals | Likely to push out competitors | Will not harm competition |
| Consumer choice | Reduced choice if rivals exit | More options for shoppers |
| Market concentration | Too high already | Healthy competition exists |
Broader Implications for Australian Supermarkets
This legal battle comes amid heightened scrutiny of supermarket competition in Australia, with the ACCC cracking down on anti-competitive practices. If Coles wins, it could encourage other chains to challenge regulatory decisions more aggressively. Conversely, an ACCC victory might strengthen its hand in future merger and expansion reviews.
What Happens Next?
The federal court will handle administrative matters tomorrow, setting a timeline for evidence and potential trial dates. A concurrent hearing will address Coles’ separate appeal to the Australian Competition Tribunal. Both cases could take months to resolve, with implications for grocery prices and local business survival in regional areas.
