Early Release Rules Tightened: 1,000 Fewer Prisoners Freed 2026

About 1,000 fewer prisoners will be released early after Andy Burnham’s intervention to exclude those convicted of rape, serious child sexual offences and grooming from the scheme. This significant policy shift aims to address public safety concerns while managing prison overcrowding. The justice secretary, Alex Norris, confirmed that 5,000 prisoners would be released over 10 months from October in England and Wales, down from the original plan of 6,000 starting in September.

Key Changes to Early Release Eligibility

The new rules exclude prisoners convicted of rape, serious child sexual offences, and grooming from the early release scheme. This change follows intense pressure from MPs, victims, campaigners, and frontline prison officers. The prime minister announced the revised plan on Monday, emphasizing the need to protect the public while addressing overcrowding.

Impact on Prison Population and Sentencing

Norris told Sky News that he would have liked to go further in blocking early releases, but doing so would have caused the prison system to “break down.” He added that the government would not need further emergency release schemes, as sentencing changes would provide “long-term security” for prison capacity. He stated, “We’re out of where the previous government got to, which is this doom loop of getting to the end, having to do emergency release schemes where individuals were let out with none of the controls that we’re talking about.”

However, he acknowledged that the proposals had “created harm” for grieving families, such as the wife of PC Andrew Harper, Lissie, and expressed his anger at being in a situation where significant changes are necessary. Harper’s mother, Debbie Adlam, said her family was “paying the price” after learning her son’s killers remained eligible for early release under the original plans.

Eligibility Criteria for Remaining Prisoners

Some prisoners serving time for certain sexual or violent offences will still be eligible for release at the halfway point of their sentence if they have not committed serious breaches of prison rules. This applies to cases like Jessie Cole and Albert Bower, which have drawn public attention.

Comparison of Original vs. Revised Release Plans

Key Takeaways

• 1,000 fewer prisoners will be released early due to tightened rules.
• Exclusions now cover rape, serious child sexual offences, and grooming.
• Release window starts in October, not September.
• Government avoids further emergency release schemes.
• Sentencing changes aim to provide long-term prison capacity stability.

Public Reaction and Future Implications

The decision has sparked mixed reactions. Victims’ families express anger and grief, while prison reform advocates welcome the focus on public safety. The government insists that the revised plan balances justice with practical constraints, but critics argue that more needs to be done to ensure dangerous offenders remain behind bars.

Norris emphasized that the system is “functioning” under the new measures, but acknowledged the emotional toll on those affected. The long-term effectiveness of sentencing changes will be monitored closely by experts and policymakers.
