Andy Burnham is focused on preventing the release of child sexual abuse perpetrators as part of the government’s early release scheme, with urgent talks on exemptions entering their final day. The move aims to protect vulnerable victims while addressing critical prison overcrowding.
Why Burnham Is Fighting to Keep Child Rapists in Prison
The Greater Manchester mayor and former cabinet minister has made it clear that releasing child rapists early poses an unacceptable risk to public safety. His stance comes as ministers weigh every exemption against the potential collapse of the criminal justice system.

Victims’ representatives and support services have warned that without proper safeguards, abuse victims would face particular danger. Burnham’s push underscores the delicate balance between prison capacity and societal protection.
The Early Release Scheme: What’s at Stake
The scheme, initially paused in September, was designed to free up prison space by releasing thousands of offenders. However, the prime minister halted the plan to include killers, rapists, and sex offenders, sparking a review expected to conclude by Monday.
An initial group of about 700 offenders may still be released this autumn, accompanied by expanded electronic tagging. Probation officers have warned of potential chaos, but ministers argue inaction could leave no capacity in jails by November.
Key Exemptions Under Consideration
Burnham specifically wants to exempt child rapists and perpetrators of serious sexual abuse from early release. The final decision rests on headroom in the prison estate, with every exception potentially triggering further demands.
| Offender Type | Current Stance | Potential Impact |
|---|---|---|
| Child rapists | Burnham pushes for exemption | Higher public safety, but more prison strain |
| Other sex offenders | Under review | Risk to victims if released |
| Killers and violent criminals | Excluded from initial plan | Reduced overcrowding relief |
What Happens Next?
Ministers have 24 hours to finalize which criminals can be released, with the review concluding by the end of Monday. The Prison Service will then prepare for any releases, but the clock is ticking.
- Child rapists may remain behind bars if Burnham succeeds.
- Electronic tagging will expand for released offenders.
- Probation services brace for potential overload.
- Further exemptions could trigger a slippery slope of demands.
Implications for the Justice System
The decision will set a precedent for how the government handles serious offenders amid overcrowding. Burnham’s stance highlights the political and ethical complexities of early release schemes.
As talks enter their final day, the nation watches to see whether public safety or prison capacity wins. The outcome could reshape criminal justice policy for years to come.
