Early Release Prisoners Reduced by 1,000 After Burnham's Tougher 2026

About 1,000 fewer prisoners will be released early after Andy Burnham’s intervention to exclude those convicted of rape, serious child sexual offences and grooming from the scheme. This significant policy shift aims to address public safety concerns while managing prison overcrowding. The justice secretary, Alex Norris, confirmed that 5,000 prisoners would be released over 10 months from October in England and Wales, down from the original plan for 6,000.

Key Changes to Early Release Prisoners Policy

The prime minister announced on Monday that prisoners convicted of rape, serious child sexual offences and grooming would be excluded from the early release scheme. This decision follows intense pressure from MPs, victims, campaigners and frontline prison officers. The revised scheme now targets lower-risk offenders, but some prisoners serving time for certain sexual or violent offences will still be eligible for release at the halfway point if they have not committed serious breaches of prison rules.

Norris told Sky News that he would have liked to go further in blocking early release, but doing so would have caused the prison system to “break down”. He added that the government would not need further emergency release schemes as sentencing changes would provide “long-term security” for prison capacity. He said: “We’re out of where the previous government got to, which is this doom loop of getting to the end, having to do emergency release schemes where individuals were let out with none of the controls that we’re talking about.”

Impact on Victims and Families

The changes have created emotional distress for grieving families, such as the wife of PC Andrew Harper, Lissie Harper. Norris expressed his anger and sorrow: “I would express how angry I am, too, at being in a situation where we’re having to make significant changes that do have real impacts on people’s lives, so that we are able to have a functioning prison system.” Harper’s mother, Debbie Adlam, said her family was “paying the price” after learning her son’s killers remained eligible for early release under the government’s plans.

Why This Matters for Prison Reform

The reduction in early release prisoners is a step toward balancing public safety with the operational realities of the prison system. By excluding the most serious offenders, the government aims to rebuild trust in the justice system. However, critics argue that even 5,000 early releases pose risks, especially for victims who feel their perpetrators are not serving full sentences.

Norris emphasized that long-term sentencing changes would prevent future crises. He noted that the previous government’s approach led to a “doom loop” of emergency releases without proper controls. The new measures include stricter eligibility criteria and enhanced monitoring for those released.
