Early Release Prisoners Cut by 1,000 After Burnham Rule Change 2026

Early release prisoners in England and Wales will see a significant reduction of about 1,000 fewer inmates under new rules championed by Andy Burnham. The justice secretary, Alex Norris, confirmed that 5,000 prisoners will be released over 10 months starting October, down from the original 6,000 planned for September. This change follows intense pressure from MPs, victims, and frontline officers to exclude those convicted of rape, serious child sexual offences, and grooming from the scheme.

The prime minister announced the tightened criteria on Monday, responding to public outcry and the emotional testimony of families like that of PC Andrew Harper. Norris expressed regret for the distress caused but emphasized the necessity of maintaining a functioning prison system. He told Sky News that going further would risk a total breakdown, yet he insisted that new sentencing reforms would provide long-term capacity security without emergency releases.

Why the Early Release Prisoners Scheme Was Adjusted

The original plan aimed to alleviate severe overcrowding by releasing up to 6,000 inmates early. However, the inclusion of serious offenders sparked widespread condemnation. Burnham, the Greater Manchester mayor, led the charge to tighten eligibility, ensuring that individuals convicted of rape, child sexual abuse, and grooming are no longer considered for early release. This intervention directly addresses public safety concerns while still attempting to manage prison numbers.

Under the revised scheme, some prisoners serving time for certain sexual or violent offences may still be released at the halfway point if they have maintained good conduct. This applies to cases like Jessie Cole and Albert Bower, but the overall number of early release prisoners has been cut to 5,000, a 16.7% reduction from the original figure.

Key Changes in the Revised Early Release Policy

• Exclusion of serious offenders: Rape, serious child sexual offences, and grooming convictions are now barred from early release.
• Reduced numbers: 5,000 prisoners instead of 6,000, spread over 10 months from October.
• Conditional eligibility: Some violent or sexual offenders may still qualify if they have no serious disciplinary breaches.
• Long-term sentencing reforms: New measures aim to avoid future emergency release schemes.

Impact on Prison Overcrowding and Public Safety

Reducing the number of early release prisoners is a balancing act between alleviating overcrowding and protecting the public. The government argues that without these measures, the prison system would collapse, leading to uncontrolled releases. However, critics, including victims' families, argue that the scheme still endangers communities by allowing certain offenders out early.

Data from the Ministry of Justice indicates that prison capacity has been at critical levels, with some facilities operating at over 99% occupancy. The revised plan aims to create breathing room while implementing structural changes to sentencing. Norris acknowledged the harm caused to families like the Harpers, saying, "I would express how angry I am at being in a situation where we’re having to make significant changes that do have real impacts on people’s lives."

Political and Public Reactions to the Change

The intervention by Andy Burnham has been praised by victims' rights groups, who see it as a step toward justice. Debbie Adlam, mother of PC Andrew Harper, said her family was "paying the price" after learning her son's killers remained eligible. The revised rules now exclude such offenders, though some with similar crimes may still be released if they meet strict criteria.

Justice secretary Alex Norris defended the policy, stating that the government is "out of the doom loop" of emergency releases. He emphasized that new sentencing changes would provide "long-term security" for prison capacity. However, he also expressed anger and sorrow over the difficult decisions, acknowledging the real-world consequences for victims and their families.

Future of Prison Reforms and Early Release Prisoners

Looking ahead, the government plans to implement broader sentencing reforms to reduce reliance on early release schemes. This includes building new prisons and investing in rehabilitation programs to lower reoffending rates. The goal is to create a sustainable system that protects the public while managing capacity effectively.

For now, the reduction of 1,000 early release prisoners marks a significant policy shift, but challenges remain. The justice system must continue to balance punishment, deterrence, and rehabilitation, all while addressing the root causes of overcrowding. As Norris noted, the situation requires tough choices, but the revised scheme aims to be fairer and safer than previous emergency measures.
