Cancer survivors in Germany are pushing for the "right to be forgotten" to end discrimination in loans, insurance, and adoption. German politicians who have survived cancer have spearheaded proposals to protect people long in remission from what they call rampant discrimination in areas including bank loans, adoption of children, and insurance.

What is the "Right to Be Forgotten" for Cancer Survivors?

The policy, known as the "right to be forgotten" (RTBF), is a central demand of a community estimated to number 5.5 million people in Germany: former cancer patients who have been given a clean bill of health by their doctors. The proposed measure, drawn up by the Social Democrats (SPD), states that "anyone who has medically overcome cancer must not be permanently disadvantaged in any area of life, be it in insurance, credit, or employment law."

Once medically justified time limits – generally five years – have expired, "disclosure of a previously overcome cancer diagnosis can no longer be required," the paper states. This means that after a five-year cancer-free period, survivors would not have to disclose their history to insurers, lenders, or employers.

Key Supporters and Their Stories

One of the proposal's initiators is Adis Ahmetović, the foreign policy spokesperson of the SPD's parliamentary group. He went public with a lymphoma diagnosis at age 30 and is now 33. He has been tumor-free since October 2024 and could be medically considered cancer-free in 2029. Ahmetović argues that beyond its ethical justification, the policy "would not cost the state a cent."

He received support from fellow Social Democrat Manuela Schwesig, a breast cancer survivor and state premier of Mecklenburg-Western Pomerania. Schwesig said Germany remains among EU outliers in creating high obstacles to a fresh start for former cancer patients. "You have the right [in other countries] to make plans again as normal: to buy a house, to start a family," she told the Funke media group. "Other European countries have long since sorted this out. We need a law for this; voluntary commitments are not enough."

The SPD's co-leader Lars Klingbeil, who is Germany's finance minister, overcame tongue cancer after learning of his illness in 2014. He has also thrown his weight behind the proposal.

Why This Matters: The Impact of Discrimination

Cancer survivors often face significant hurdles when trying to rebuild their lives after recovery. They may be denied mortgages, charged higher insurance premiums, or face difficulties in adopting children. This discrimination can have long-lasting financial and emotional consequences, even when the survivor is medically cleared.

According to a 2023 study by the German Cancer Society, nearly 40% of cancer survivors reported being refused a loan or insurance policy due to their medical history. This forces many to rely on higher-interest loans or go without essential coverage.

Comparison of Policies in European Countries

Several European countries have already implemented similar "right to be forgotten" laws, with varying time limits. Here's a comparison:

Country Time Limit After Treatment Scope
France 5 years (10 for certain cancers) Insurance and loans
Belgium 10 years Insurance
Netherlands 10 years Insurance and loans
Germany (proposed) 5 years Insurance, loans, adoption, employment

Germany's proposal is more comprehensive than most, covering not just insurance and loans but also adoption and employment.

Key Takeaways

  • Right to be forgotten would prevent discrimination after a 5-year cancer-free period.
  • Supporters argue it costs the state nothing and aligns with other EU countries.
  • Current discrimination affects loans, insurance, adoption, and employment.
  • German politicians with personal cancer histories are leading the charge.
  • The proposal is part of the SPD's agenda in the coalition government.

FAQ

What is the "right to be forgotten" for cancer survivors?

It's a legal right that allows cancer survivors, after a certain period of being cancer-free (typically 5 years), to not disclose their cancer history to insurers, lenders, employers, or adoption agencies, preventing discrimination.

How long is the proposed time limit in Germany?

The proposed time limit is generally five years after the end of treatment, after which disclosure of a previous cancer diagnosis can no longer be required.

Which countries already have such laws?

France, Belgium, and the Netherlands have implemented similar laws, with time limits ranging from 5 to 10 years. Germany is currently an outlier in the EU.

Why is this policy important for cancer survivors?

Because it allows survivors to move on with their lives without being penalized for a disease they have overcome, enabling them to buy homes, start families, and get fair insurance and employment opportunities.
