The world's biggest ultra-processed food companies have filed scores of lawsuits challenging government policies that tackle junk diets, according to a new investigation. Ultra-processed food (UPF) is linked to harm in every major organ system and poses a seismic threat to global health. Worldwide consumption is rising, making up as much as half the average diet in many countries, including the UK, the US, and Australia.

Governments have adopted measures to fight back: front-of-pack warning labels, marketing restrictions on unhealthy products, and taxes on junk food. Publicly, UPF giants insist they support these policies and want to help consumers make informed choices. But an investigation by the Guardian in collaboration with academics and media partners across four continents found many of these same companies are taking governments to court to overturn, weaken, or delay the rules.

How Many Lawsuits Have Been Filed?

From 2010 to 2025, a total of 235 lawsuits were lodged over health policies targeting UPF in Mexico, Colombia, Brazil, the US, and the UK. Three-quarters were filed by UPF manufacturers or their trade associations. Of the cases where the plaintiff was identifiable, 38% came from just eight parent corporations: Coca-Cola, PepsiCo, Mondelēz, Kellogg’s, Danone, Ferrero, Xignux, and Heartland Food Products Group.

Country Number of Lawsuits Outcome (Resolved Cases)
Mexico 89 75% lost by food giants
Colombia 45 80% lost
Brazil 38 70% lost
United States 42 60% lost
United Kingdom 21 65% lost

Dozens of cases are ongoing. Of those resolved, three-quarters were lost by the food giants. However, the lengthy legal battles often delay implementation of health rules for years, allowing UPF sales to continue unabated.

Key Takeaways: Why This Matters

  • UPF companies use litigation as a strategy to obstruct public health measures, even while publicly supporting them.
  • Governments worldwide are being sued by some of the most powerful food corporations on the planet.
  • Despite losing most cases, the delays undermine efforts to reduce diet-related diseases like obesity, diabetes, and heart disease.
  • Consumers and advocates must push for stronger legal protections for health regulations.

How the Legal Strategy Works

The lawsuits often claim that warning labels violate free speech or that taxes discriminate against certain products. In some cases, companies request courts to keep their identities confidential. This “shadow litigation” makes it harder for the public to see who is fighting health rules.

What Can Be Done?

Public health experts recommend that governments preemptively strengthen legal frameworks for nutrition policies. They also call for transparency in who funds anti-regulation lawsuits. Citizens can support organizations that monitor corporate litigation and advocate for stricter UPF regulation.

FAQ

What is ultra-processed food (UPF)?

Ultra-processed foods are industrial formulations made mostly from substances extracted from foods, often with added additives. They include sugary drinks, packaged snacks, instant noodles, and many breakfast cereals. UPF has been linked to serious health issues including obesity, cancer, and heart disease.

Why are UPF companies suing governments?

They aim to overturn or delay health regulations like warning labels, advertising bans, and junk food taxes. The lawsuits often argue that the policies violate corporate rights, such as freedom of commercial expression, or are unconstitutional.

How many lawsuits have been filed?

At least 235 lawsuits were identified between 2010 and 2025 across Mexico, Colombia, Brazil, the US, and the UK. Most were filed by food manufacturers or their trade associations.

Do the companies win these lawsuits?

No. Of the cases that have been resolved, three-quarters were lost by the food giants. However, the lengthy legal battles can delay policy implementation for years, which still harms public health.

In conclusion, the ultra-processed food industry’s courtroom strategy reveals a stark disconnect between their public support for health and their private actions. As consumption continues to rise, consumers and governments must stay vigilant against corporate tactics that undermine global nutrition.
